A Landlord's Legal Duty Under the Gas Safety Regulations 1998

The Landlord Gas Safety Record — still widely called a CP12 — is how you show you have met your duties under the Gas Safety (Installation and Use) Regulations 1998. In short:

A safety check every 12 months

Every gas appliance and flue you provide for your tenants must be checked by a Gas Safe registered engineer, and each check completed within 12 months of the last one.

A copy for your tenants

Existing tenants must be given a copy of the record within 28 days of the check. New tenants must be given a copy before they move in.

Records kept for at least 2 years

Keep each gas safety record for at least two years, so you can show the checks have been done.

Appliances kept in a safe condition

Separately from the annual check, the same regulations require you to keep the gas pipework, appliances and flues you provide maintained in a safe condition.

What the gas safety record shows

A description and the location of each appliance and flue checked
The engineer's name, signature and Gas Safe registration number
The date of the check and the address of the property
The landlord's (or agent's) name and address
Any safety defect found and any action taken to put it right

What the Engineer Checks on a Gas Safety Inspection

Each gas appliance in the property is checked in turn — typically the boiler, plus any gas fire, cooker or water heater. For each one, the checks cover:

Appliance operation

Each appliance is checked to confirm it is working and burning correctly.

Gas rate and burner pressure

Where it applies to the appliance, the gas rate or burner pressure is measured against the manufacturer's figures.

Flues and chimneys

The flue is checked to confirm the products of combustion are being safely removed.

Ventilation

The room or space is checked for an adequate supply of air for the appliance to burn safely.

Safety devices

Safety devices, such as the flame failure device, are tested to make sure they work.

Pipework tightness

Where a tightness test is carried out, it confirms the gas pipework is not leaking. The record shows whether one was done.

What Happens If an Appliance Fails the Gas Safety Check

Gas Safe registered engineers deal with unsafe appliances under the Gas Industry Unsafe Situations Procedure. It sorts what is found into two main categories:

Immediately Dangerous. The appliance or installation is a danger to life or property if it stays connected. With the permission of the owner or occupier, it is disconnected from the gas supply and labelled, and a warning notice is issued.
At Risk. There are faults that could become dangerous. With permission, the appliance is turned off, a warning notice is issued, and it should not be used until it has been repaired.

Either way, the fault is recorded on the gas safety record. It is then the landlord's responsibility to arrange the repair before the appliance is used again.
